CAP responds to the Accountant in Bankruptcy's stage three review of Scotland's statutory debt solutions

CAP’s response to the Accountant in Bankruptcy’s consultation of its stage three review of Scotland’s statutory debt solutions. 

This is an important review for debt solutions in Scotland and CAP welcomed the opportunity to feed into it. In general, CAP felt that statutory debt solutions generally work well in Scotland; however, this stage three review provided some opportunity to call for improvements. CAP would like to see more scope for changes in the Minimal Asset Process (MAP) and Sequestration thresholds and reapplication periods, as well as more powers awarded to the AiB to enforce creditor compliance post-insolvency.
